Individual flexibility arrangements (IFAs)

An individual flexibility arrangement (IFA) is a written agreement used by an employer and employee to change how parts of an award apply to them. It can be used to make alternative arrangements that suit the genuine needs of the employer and employee. An IFA must be in writing and be genuinely agreed to without pressure.

The Horticulture Award and the Wine Industry Award allow for IFAs to be used. However, an employer cannot make an IFA a condition of employment. An employee also cannot be treated adversely or discriminated against for not agreeing to an IFA.

The IFA must result in the employee being better off overall at the time the agreement is made than the employee would have been if no IFA had been agreed to.

IFAs – Horticulture Award

Under the Horticulture Award, an employer and employee can enter into an IFA to:

  • arrangements for when work is performed
  • overtime rates
  • penalty rates
  • allowances, or
  • annual leave loading.
